The Retail Leases Regulation 2022 (‘the Regulation’) commenced on 1 January 2023 and as a result fitness centres (including gymnasiums, yoga centres, barre, Pilates and dance studios) and small bars (with a maximum capacity of 120 patrons) are now covered by the provisions of the Retail Leases Act 1994, which sets out the rights and responsibilities of lessors and lessees under a retail lease.
The Regulation will apply to existing leases entered before 1 January 2023 only in relation to the way disputes are dealt with. That is, disputes must be submitted to mediation before proceedings can be commenced even if the lease for these types of businesses was entered into before 1 January 2023.
For leases entered on or after 1 January 2023 all provisions of the Retail Leases Act 1994 will apply.
