As at 1 April 2022, parties to current family law property proceedings can now request information direct from the Court about your former spouse’s superannuation from the Australian Taxation Office. This only applies to property applications where an Initiating Application has been filed with the Federal Circuit and Family Court of Australia and not to property settlement negotiations occurring where Court proceedings have not been filed.
The request is made through the Commonwealth Courts Portal. Parties should be able to view the response within 7 days.
By introducing this new measure, it minimises the ability of a party to withhold information about their superannuation interests.
