In NSW you must obtain a swimming pool compliance certificate when selling your house or alternatively provide a certificate of non compliance.
A swimming pool compliance certificate will be issued where the swimming pool meets safety standards and a certificate of non compliance will be issued if the pool does not meet safety standards.
A swimming pool compliance certificate if issued is valid for three years from the date of issue. If your swimming pool is relatively new you may rely on an occupation certificate which has been issued in the last three years that includes the pool.
In addition to the compliance certificate you should also annex to the Contract for Sale a copy of the swimming pool registration certificate. This can be obtained through the NSW Swimming pool register at https://www.swimmingpoolregister.nsw.gov.au/.
If you are a vendor it is important to ensure that the swimming pool compliance certificate/non compliance certificate/occupation certificate is in the Contract for Sale as at the date of exchange. It is a “prescribed document” and if left out of the Contract for Sale at the time of exchange may give the Purchaser the right to pull out of the Contract and get their deposit back.
It is essential that your Contract for Sale is prepared carefully and contains all of the prescribed documentation so as to ensure that your Purchaser has no right of rescission following exchange.
